See they had video evidence of a cop using unwarranted force. If she just gathered the evidence and ran like hell she might have made it out ok and been able to (a) sue the Denver PD and (b) take it to the media.

So the police literally snatch her up and arrest her to muzzle her, and make any lawsuit look like it was a sour grapes thing. when you sue the PD it looks different to the court if they arrested you on some charges, or if they hit you in the face with a baton and then never arrested you (obviously they would have arrested someone doing something so illegal as to need a baton to the face).

"Last night at approximately 7:30pm I was arrested as part of a mass arrest at 15th & Court and charged with disrupting a permitted assembly and blocking public streets. A third charge - throwing rocks and missiles - was listed on my pre-printed ticket, but then crossed out.

At the time I was not protesting. I was acting as an observer for the People's Law Project, and was dressed in a button shirt and a neon-green baseball cap stating that I was acting as a representative of the National Lawyers Guild. I followed the protestors out of Civic Center Park, but remained on the sidewalk until pushed by riot police into the street. At no time during the abortive march did any legal observer, or any marcher that I have spoken to, observe any destruction of property, any thrown objects, or ANY ORDER TO DISPERSE BY THE POLICE.

At some point during my visit to Gitmo on the Platte, the compact flash card I had been carrying that contained photographic documentation of the protest disappeared. This included pictures of the badges of some of the officers involved, images of a marcher OBEYING police orders being shot with pepper spray point-blank in the eyes while trying to retreat (when I was hauled away he was sitting with a street medic, and I could hear him sobbing again and again, "I can't see..."), and photographs of a second protestor who was shot three times by what appeared to be three separate officers with bean-bag guns while KNEELING, motionless, 15 FEET AWAY, hands outstretched as if in prayer, and wearing nothing but a pair of POCKETLESS shorts."

After a year of asset protection I have never ever had to lay into some one. Asset protection is basically a private police officer, but I never exercise my duty outside of my jurisdiction. I am no longer in asset protection.

You never ever lay a hand on a private citizen like that, you take them by the arm and tell them they are under arrest for disobeying an officer of the law. That is the law, you cannot ever harm a private citizen, no matter how much of an asshole they are being.

Officers of the law have to tell a citizen why they are being arrested, no matter what. If they don't it is false imprisonment. The bill of rights requires it. Now before we scream about how she was going on and egging him on, thats exactly what he should not have done to her. Read my bold comment.

If I cant do that in my line of work then they cant either we are all governed by the same laws, that we swore to uphold.

MG, you magnificent macho sod. There are actual guidelines on escalation of force. Punching someone in the face with a baton is pretty high up there on the force continuity.

See, we don't know what took place before this video starts. What we do know is that the cop assaults her and then when she is on the ground, he DOES NOT arrest her or detain her or question her or continue to do anything that would seem to necessitate the force being used.

See, if he was trying to control a situation or make her obey orders, then if she is so clear not in compliance with his order, they would arrest her. If she was disobeying his order to "moOOOoove" then the question is, is the proper response to hit her in the face/throat area?

Yes, we don't know if she was calling him names or taunting him, but we do know that:
(a) he was in no physical danger
(b) there was not a crowd / wall of people
(c) he should have been in fear for his safety
(d) he was selecting out one person (no one else around her) to push

No one else in the immediate area was being shoved.
If moving people was so important for safety or whatever, then why was she allowed to lay on the ground in the exact same location, why did the police not drag her out of the way? Why was she not arrested.

They should start with verbal command and then use force to control a situation if someone disobeys the verbal order. If someone disobeys a verbal order in these situations they would arrest her. The fact that she was not immediately arrested should tell you something.

You are absolutely right - I hadn't thought of that. To be honest, I paid little attention to the events after the strike. I knew the thread would focus on that itself.

Up until then, I was going to say "over use of force != brutality", but you make a very solid point, JD.

I signed my life into guardianship of those rights, so don't think for a second that I think they should be smothered.

Hrmmm, I also looked frame by frame, slowmo, and multiple times.

My opinion? (Audio, and my own demented form of logic)
Cop: Shoves protester, saying "back it up bitch"
Protester: Feels cop has no right to touch her, hopes someone would video tape what happens when she says "fuckin do it again!"

Camera moves to view (no longer opinion, video fact):
Cop: does shove her again, this time with considerably greater force and an inital impact, at her shoulders, baton across upper chest, knocking her down.
Cop: "Back up bitch!"

I think what you see here was an escalation against someone who was obviously there for a confrontation (people just watching/showing support don't need bullhorns). Not for me to say if it was warranted or not, but unless you were there and saw everything, including what she said to him while the video was blurred out and the audio edited, it's not for you to say either.

I want to see or at least hear the 10 previous seconds whoever youtubed this obviously felt the need to edit out.

Also, that wasn't a head shot, it was a standard forward push used to force a crowd backwards. Generally however, it's done with the end of the baton at mid chest height. That was a little high, but still not in the head.

Oh and look, theres a megaphone on the ground beside her. Makes you wonder how long she'd been there playing the goody goody two shoes facade.

Maybe it's just me, but this whole video...the way it's edited, the dialog that is heard, the basic reactions of the participants and the extras, etc...seems really really staged.

Like I said, maybe it's just me, but after the first viewing my gut said "fake". If it is totally legit then I think the cop did step way over the line...however I think very few of us know what it feels like to walk close to the line every day. I used to play in a tabletop rpg with a cop (he had his pistol on him even when we were playing...it was very surreal) and he and I had some very frank discussions about his profession. When I first met him I thought "Whoa...this guys a giant dickhead." Once I got to know him, and more importantly once he got to know me my opinion changed quite a bit. We're still friends and I have a mountain of respect for him, and a better picture of what its like to walk in his boots...every day. One of the most memorable things that he said to me went something like this:

"I don't think people out in the general population know how it affects your psychology to constantly be reminded of the math. The math of how we [cops]perceive "you guys" viewing us ends up roughly like this.
-75% of the population thinks we're automatically an asshole and are only around to harass them
-20% genuinely hates us and will do anything to hinder or foil us without actively committing a crime
-3% are just waiting for their chance to shoot us and get away with it
Lastly there are the 2% who seem to appreciate what we do and generally try to be as helpful as possible...and those two percent are almost universally military, ex-military, civil servants of some kind or someone who is already committing some crime that we probably wouldn't give a shit about but they're scared out of their continence that we might catch them.

If the math looked like that on my occupation I might come across as abrasive and callous after a while as well.

I agree with you BillOreilly. I think there are many instances in which striking somebody with a baton while their back is turned is warranted. This is definitely one of those instances. Especially considering the fact that she was female, the fact that she was tiny and the fact that she was peacefully protesting.
